Terms of Service

1. Agreement to Terms

By accessing or using arch-market (“the Service”), operated at market.thearchkit.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. User Accounts

To publish or interact with content, you must create an account using GitHub, Google, or email authentication via our identity provider (Keycloak). You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Published Content and Licensing

Ownership: You retain full ownership of any content you publish on arch-market, including skill files, graph files, and presets (“Configs”).

License to arch-market: By publishing a Config, you grant arch-market a worldwide, non-exclusive, royalty-free license to host, display, distribute, and make available your Config through the Service. This license exists solely to operate and improve the Service. If you remove your Config, this license terminates, except for copies already downloaded by other users.

License to other users: Configs are distributed under the license you specify when publishing (e.g., MIT, Apache-2.0). You are responsible for choosing an appropriate license. If no license is specified, Configs are provided under the MIT License by default.

Representations: You represent that you have all necessary rights to publish any Config and that your Configs do not infringe on the intellectual property rights of any third party.

5. Prohibited Conduct

You agree not to:

  • Publish Configs containing malicious code, malware, or code designed to harm systems
  • Publish spam, duplicate, or misleading content
  • Publish content that infringes copyrights, trademarks, or other intellectual property rights
  • Attempt to gain unauthorized access to other accounts or the Service's infrastructure
  • Use the Service to harass, abuse, or threaten other users
  • Scrape, crawl, or use automated means to access the Service without permission
  • Circumvent rate limits, security measures, or access controls
  • Use the Service for any illegal purpose

Violations may result in content removal, account suspension, or permanent ban at our sole discretion.

6. Content Moderation

We reserve the right to review, flag, remove, or restore any Config at our discretion. Users may report Configs that violate these Terms. Configs that receive multiple reports may be automatically flagged for review. We are not obligated to monitor all content but may do so to enforce these Terms.

7. Intellectual Property and DMCA

If you believe content on arch-market infringes your copyright, you may submit a DMCA takedown notice to [email protected] including:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the infringing material and its location on the Service
  • Your contact information (name, address, email, phone number)
  • A statement that you have a good faith belief the use is not authorized
  • A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

8. Third-Party Services

The Service integrates with third-party services including GitHub (authentication and OAuth), Google (authentication and OAuth), Cloudflare (CDN and security), and Resend (email delivery). Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Configs published by users are not reviewed or endorsed by arch-market. You download and use Configs at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, arch-market and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your use of or inability to use the Service; (b) any unauthorized access to or use of our servers; (c) any content obtained from the Service; or (d) any third-party conduct on the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless arch-market and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

You may terminate your account at any time through the account settings page. We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and limitations of liability) will survive.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in California. You consent to personal jurisdiction in these courts.

14. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at [email protected]. If a dispute is not resolved within 30 days, either party may proceed with formal legal action.
